Loamy Website Privacy Notice

Effective date: May 15, 2026 Last updated: May 15, 2026

This Website Privacy Notice (“Website Privacy Notice”) describes how Loamy Inc. (“Loamy,” “we,” “us,” or “our”) collects, uses, shares, and protects information in connection with your access to and use of the public Loamy marketing website at loamy.app and any other public marketing, informational, or promotional web property Loamy makes available under the loamy.app domain (collectively, the “Website”). This Website Privacy Notice applies only to information collected through the Website.

This Website Privacy Notice is NOT the Loamy Privacy Policy. Information Loamy collects about you when you create a Loamy account, sign in, transact, or otherwise use the signed-in Loamy product at app.loamy.app is governed by a separate document called the Loamy Privacy Policy. The Loamy Privacy Policy describes how Loamy handles account information, identity and verification information, listing content, order information, payment information processed through Loamy’s third-party payment provider, in-app messaging content, dispute submissions, and other information generated by use of the signed-in product. If you use the signed-in product, both this Website Privacy Notice (for your visits to loamy.app) and the Loamy Privacy Policy (for your use of the signed-in product) apply.

This Website Privacy Notice is incorporated into and forms part of the Loamy Website Terms of Use.

1. Information We Collect Through the Website

We collect information in three ways: information you provide directly through the Website, information collected automatically when you visit the Website, and information we receive from third parties in connection with the Website.

1.1 Information You Provide Directly

When you use the Website, you may provide us with the following information:

  • Contact and inquiry information. If you submit a contact form, a support inquiry form, a sales or partnership inquiry form, or otherwise reach out to us through the Website, we collect the information you provide, which may include your name, email address, phone number, business or organization, the city or state where you are located, the topic of your inquiry, and the content of your message.
  • Newsletter and mailing-list information. If you subscribe to a Loamy newsletter, blog update list, marketing list, or similar communication, we collect the email address you provide and any related preferences. You may unsubscribe at any time using the link included in each communication.
  • Survey or feedback responses. If you respond to a public-facing survey, poll, or feedback form on the Website, we collect the responses you submit.
  • Account-interest information. If you express interest in opening a buyer or merchant account through a Website form (for example, a “Get started” or “Become a supplier” form) before actually creating an account at app.loamy.app, we collect the information you provide in that form. If you go on to create an account, your account information is then handled under the Loamy Privacy Policy, not this Website Privacy Notice.

1.2 Information Collected Automatically

When you visit the Website, we automatically collect certain information about your device and your interactions with the Website, including:

  • Device and technical information. IP address, device identifiers, device type, operating system, browser type, language, time-zone setting, screen size, and similar technical information.
  • Usage information. Pages or screens you view, features you interact with, links you click, time and duration of your session, referring and exit pages, search queries entered on the Website, and other interactions with the Website.
  • Approximate location. Approximate location derived from your IP address (such as country, state, or city). The Website does not request precise device location.
  • Cookies and similar technologies. Information collected through cookies, web beacons, pixels, local storage, and similar technologies, as further described in Section 5.

1.3 Information We Receive From Third Parties

We may receive information about you from third parties in connection with the Website, including:

  • Analytics providers. Pseudonymous usage and engagement data as described in Section 5.
  • Marketing or advertising platforms. Where Loamy runs marketing campaigns on third-party platforms, those platforms may share aggregated or pseudonymous campaign-performance information with us (for example, click-through metrics).
  • Email and outreach service providers. Where Loamy uses third-party email delivery, outreach, or anti-spam services, those providers may share deliverability data, engagement data, or bounce/spam-flag information with us.

1.4 Data Minimization

We collect only the information reasonably necessary to operate the Website, respond to your inquiries, deliver communications you have requested, understand how the Website is used, prevent fraud and abuse, and meet our legal obligations.

2. How We Use Information Collected Through the Website

We use information collected through the Website for the following purposes:

  • To operate and secure the Website. Serve pages, fulfill requests, maintain Website security and availability, prevent fraud and abuse, and detect and respond to security incidents.
  • To respond to inquiries. Reply to contact-form submissions, support inquiries, sales inquiries, partnership inquiries, press inquiries, and similar messages you send us through the Website.
  • To deliver communications you have requested. Send newsletters, blog updates, marketing communications, and other communications you have opted in to receive, including transactional confirmations related to those subscriptions.
  • To understand and improve the Website. Analyze usage patterns, measure the performance of pages and features, run A/B tests, identify issues, and develop and improve Website content and functionality.
  • To measure and improve marketing. Measure the performance of marketing campaigns, audiences, channels, and creative assets; analyze attribution; and inform future marketing decisions. Loamy does not use information collected through the Website for cross-context behavioral advertising.
  • To facilitate onboarding to the signed-in product. Process expressions of interest in opening a buyer or merchant account, route inquiries to the appropriate Loamy team, and provide information helpful to your decision whether to sign up.
  • To comply with law. Respond to legal requests, comply with applicable laws and regulations, and respond to law enforcement, regulators, and courts as required by applicable law.
  • For other purposes you consent to or that are otherwise permitted by law.

3. How We Share Information Collected Through the Website

We share information collected through the Website as needed to operate the Website and as described below. Loamy does not sell personal information collected through the Website, and we do not share personal information for cross-context behavioral advertising purposes.

  • With service providers. We share information with third-party service providers we use to operate the Website, including hosting and infrastructure providers, content delivery networks, analytics providers (including Google Analytics 4 as described in Section 5), email delivery and marketing-automation providers, fraud-prevention services, content management providers, customer-support tooling providers, and similar services. These providers are subject to confidentiality obligations and are permitted to use the information only as needed to provide their services to us.
  • With law enforcement, regulators, and courts. We may share information as required by law, legal process, subpoena, court order, or governmental request, and to investigate and respond to suspected fraud, misconduct, illegal activity, or threats to safety. We may also share information to enforce the Loamy Website Terms of Use, protect our rights, or protect the rights and safety of users or others.
  • In connection with a corporate transaction. If Loamy is involved in a merger, acquisition, financing, sale of assets, reorganization, bankruptcy, or similar transaction, we may share information with parties to and advisors involved in the transaction, subject to appropriate confidentiality and (where required) notice.
  • With your consent. We may share information for other purposes when you direct or consent to the sharing.

We may also share aggregated, de-identified, or anonymized information that cannot reasonably be used to identify you for any purpose.

If you go on to create a Loamy account at app.loamy.app, information you provide through the Website that is reasonably related to your account (for example, information from a “Get started” or “Become a supplier” form) may be associated with your account at that time and handled thereafter under the Loamy Privacy Policy.

4. No Sale, No Cross-Context Behavioral Advertising, No Targeted Advertising, No Profiling

Loamy does not sell personal information collected through the Website. Loamy does not share personal information collected through the Website for cross-context behavioral advertising purposes. Loamy does not engage in targeted advertising based on personal information collected through the Website. Loamy does not use personal information collected through the Website for profiling that produces legal or similarly significant effects.

5. Cookies, Analytics, and Tracking Technologies

5.1 Cookies and Similar Technologies

The Website uses cookies and similar technologies (such as web beacons, pixels, and local storage) to operate, secure, analyze, and improve the Website. Cookies fall into the following categories:

  • Essential cookies. Required for the Website to function (for example, to remember session state, balance traffic across servers, and prevent fraud and abuse). The Website will not work properly without these.
  • Functional cookies. Remember your preferences and settings (for example, language, region, or display preferences) to improve your experience.
  • Analytics cookies. Help us understand how the Website is used so we can measure and improve it.
  • Security cookies. Help us detect and prevent fraud, abuse, and security risks.

You can control most cookies through your browser settings. Blocking essential cookies will likely prevent the Website from working correctly.

5.2 Google Analytics

We use Google Analytics 4 to understand how visitors interact with the Website. Google Analytics collects pseudonymous information about your visits, including pages viewed, time on page, referring sources, device and browser type, and approximate location derived from IP address. This information is processed by Google subject to Google’s own privacy practices.

You can opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on, available at https://tools.google.com/dlpage/gaoptout, or by using browser-level controls (such as Do Not Track signals or cookie blocking).

5.3 No Session-Replay Tools

Loamy does not use session-replay technologies (such as tools that record video-style recordings of your interactions with the Website).

5.4 No Cross-Site Tracking for Advertising

Loamy does not embed third-party advertising tracking pixels on the Website for the purpose of building cross-site advertising profiles. Loamy does not participate in real-time bidding or other advertising-ecosystem data flows based on Website visitor information.

5.5 Do Not Track

Some browsers offer a “Do Not Track” signal. There is currently no industry standard for how websites should respond to Do Not Track signals, and Loamy does not respond to Do Not Track signals at this time. We will update this Website Privacy Notice if our practices change.

6. Your Choices

6.1 Marketing Communications

You can opt out of marketing communications at any time using the unsubscribe mechanism in those communications or by contacting us at support@loamy.app. Even if you opt out of marketing communications, we may still send you communications related to inquiries you initiate or other operational matters.

6.2 Cookie Controls

You can manage cookies through your browser settings as described in Section 5.

6.3 Inquiry Information

If you have submitted a contact form, support inquiry, or similar message through the Website and would like that submission deleted from our records (subject to legal and operational retention obligations described in Section 8), contact us at support@loamy.app.

7. Your Rights Under State Privacy Laws

Several U.S. states (including California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Florida, and Montana) have enacted comprehensive privacy laws that give residents specific rights regarding their personal information. This Section 7 applies to residents of those states and any other state that enacts a comparable privacy law. Loamy honors these rights for residents of every U.S. state and territory in which a comparable privacy law is in effect, even if the state is not listed by name above.

7.1 Rights You May Have

Subject to applicable law and certain exceptions, you may have the right to:

  • Know and access. Request to know what personal information we collect, use, share, or sell about you, and request a copy of that information in a portable format.
  • Request that we correct inaccurate personal information about you.
  • Request that we delete personal information we have collected from you.
  • Opt out of sale or sharing. Request that we not sell or share your personal information. Loamy does not sell personal information, and we do not share personal information for cross-context behavioral advertising purposes.
  • Opt out of targeted advertising. Request that we not use your personal information for targeted advertising. Loamy does not engage in targeted advertising.
  • Opt out of profiling. Request that we not use your personal information for profiling that produces legal or similarly significant effects. Loamy does not use personal information for this kind of profiling.
  • Non-discrimination. Not be discriminated against for exercising any of these rights.

Some rights are subject to exceptions. For example, we may decline a deletion request if we are required to retain the information to comply with law, complete a transaction, detect fraud, or for similar purposes.

7.2 How to Exercise Your Rights

To exercise any of these rights, contact us at support@loamy.app with the subject line “Privacy Rights Request” and include:

  • Your full name.
  • The email address you used to contact us through the Website (if any).
  • The state in which you reside.
  • The specific right you wish to exercise.
  • Sufficient information for us to verify your identity (we may request additional information as needed to verify your identity before processing your request).

We will respond to your request within the timeframe required by applicable law (generally 30 to 45 days, depending on the state, with a possible extension where permitted).

7.3 Authorized Agents

You may designate an authorized agent to exercise rights on your behalf, where permitted by law. We may require the authorized agent to provide proof of authorization and may require you to verify your identity directly.

7.4 Appeals

If we deny your privacy rights request and you reside in a state that provides an appeal right, you may appeal our decision by contacting us at support@loamy.app with the subject line “Privacy Rights Appeal.” We will respond to appeals within the timeframe required by applicable law.

7.5 California-Specific Disclosures

For California residents, the categories of personal information described in Section 1 of this Website Privacy Notice correspond to the categories of personal information identified in the California Consumer Privacy Act (CCPA), including identifiers (such as IP address, device identifiers, and email address), internet or other electronic network activity (such as pages viewed and links clicked), geolocation data (approximate location derived from IP address), and inferences drawn from the foregoing for analytics and Website improvement purposes. The purposes for which we collect and use each category are described in Section 2. The categories of recipients with whom we share each category are described in Section 3.

Loamy has not sold or shared (as those terms are defined under the CCPA) personal information of California residents collected through the Website in the preceding twelve months and does not currently do so.

California residents have the additional right to designate an authorized agent and to receive a notice of financial incentive (Loamy does not currently offer financial incentives in exchange for personal information).

8. Data Retention

We retain information collected through the Website for as long as needed to fulfill the purposes described in Section 2, including:

  • To operate and secure the Website.
  • To respond to and follow up on inquiries you have submitted.
  • To deliver communications you have requested, until you unsubscribe.
  • To analyze and improve the Website.
  • To comply with our legal, tax, accounting, and regulatory obligations.
  • To detect and prevent fraud and abuse, and to maintain security.
  • To resolve disputes, enforce the Loamy Website Terms of Use, and defend legal claims.

Retention periods vary based on the type of information and applicable legal and regulatory requirements. Inquiry records and email communications are typically retained for at least the duration of the inquiry conversation and a reasonable period thereafter for support, recordkeeping, and dispute-handling purposes. Analytics data is typically retained in aggregated or pseudonymous form according to the analytics provider’s default retention settings, with adjustments where Loamy elects shorter retention.

We may indefinitely retain aggregated, de-identified, or anonymized information that cannot reasonably be used to identify you, for any lawful purpose.

If you create a Loamy account, information from your Website visits that is reasonably related to your account may be associated with your account at that time, and the retention provisions of the Loamy Privacy Policy will govern that information from that point forward.

9. Data Security

We use commercially reasonable administrative, technical, and physical safeguards designed to protect information collected through the Website against unauthorized access, disclosure, alteration, and destruction. However, no method of transmission over the internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security.

If we become aware of a security incident that affects information collected through the Website, we will notify affected individuals and applicable authorities as required by applicable law.

10. Children’s Privacy

The Website is not intended for use by anyone under 18 years old. We do not knowingly collect personal information from anyone under 18 through the Website. If you believe a person under 18 has provided personal information to us through the Website, please contact us at support@loamy.app and we will take appropriate steps to delete that information.

11. International Users

The Website is intended for users in the United States. We do not direct the Website to, or knowingly collect information from, users outside the United States. If you access the Website from outside the United States, you do so at your own risk, and you understand that your information will be transferred to, processed, and stored in the United States, where data protection laws may differ from those in your country.

12. Third-Party Links and Services

The Website may contain links to or integrate with third-party websites, applications, or services (such as social media platforms, partner websites, blog references, and similar third-party content). This Website Privacy Notice does not apply to those third parties. We are not responsible for the privacy practices of third parties. Please review the privacy policies of any third party before providing information to them.

13. Changes to This Website Privacy Notice

We may update this Website Privacy Notice from time to time. If we make a material change, we will notify you through the Website, by email if we have your email address on file, or by other reasonable means. Changes take effect on the date stated in the notice (or, if no date is stated, the date of the notice). Your continued use of the Website after the effective date of any change constitutes your acceptance of the updated Website Privacy Notice. If you do not agree to a change, you must stop using the Website.

14. Relationship to the Loamy Privacy Policy

This Website Privacy Notice governs information collected through the Website at loamy.app. The Loamy Privacy Policy governs information collected through the signed-in Loamy product at app.loamy.app, including account information, identity and verification information, listing content, order information, payment information processed through Loamy’s third-party payment provider, in-app messaging content, dispute submissions, and other information generated by use of the signed-in product.

In the event of any conflict between this Website Privacy Notice and the Loamy Privacy Policy regarding information that is genuinely tied to use of the signed-in product, the Loamy Privacy Policy controls.
